The plain-English version: SunBorn collects basic information needed to fulfill your orders and improve your experience — name, contact, payment, and how you use our site. We share data only with partners who help us operate (payment processors, fulfillment, marketing platforms, and Seel if you purchase Purchase Assurance™). We never sell your SMS opt-in data. You have rights over your data including access, deletion, and opting out of targeted advertising. Contact info@sunbornfc.com to exercise any of these rights.
SunBorn Collective ("we," "us," "our") operates the website at sunbornfc.com (the "Site") and provides products and services through it (collectively, the "Services"). SunBorn is powered by Shopify's e-commerce infrastructure.
This Privacy Policy explains how we collect, use, and share your personal information when you visit the Site, make a purchase, or otherwise interact with us. If there is a conflict between our Terms of Service and this Privacy Policy regarding the processing of personal information, this Privacy Policy controls. By accessing the Site, you acknowledge the practices described below.
01 // Information We Collect
Depending on your interaction with the Services, we may collect or process the following categories of personal information:
- Contact information: Name, billing address, shipping address, phone number, email address
- Payment information: Payment card details, transaction history, payment method (processed by Shopify Payments and other payment processors, not stored directly by SunBorn)
- Account information: Username, password, security questions, preferences (if you create an account)
- Order information: Items viewed, added to cart, purchased, returned, or exchanged
- Communications: Information included in support inquiries, chat messages, or direct correspondence with our team
- Device information: Browser type, operating system, network connection, IP address, unique device identifiers
- Usage data: Pages visited, time on site, navigation patterns, referral sources
02 // How We Collect Information
We gather information through three vectors:
- Directly from you: When you create an account, complete a purchase, sign up for marketing communications, contact customer support, or otherwise interact with the Site
- Automated technologies: Through cookies, tracking pixels, web beacons, and similar technologies as you navigate the Site
- Third-party partners: From service providers, fulfillment partners, payment processors, and marketing platforms that assist with our operations
03 // How We Use Your Information
We use the information we collect for the following purposes:
- Order fulfillment: Process payments, arrange shipping, facilitate returns, and maintain your account
- Customer service: Respond to your inquiries, resolve issues, and provide support

- Marketing partners: Email and SMS platforms (such as Klaviyo), advertising networks for targeted advertising (you may opt out — see Section 09)
- Analytics providers: Services that help us understand how customers use the Site
- Legal authorities: Government agencies, law enforcement, courts, or regulators when legally required
- Business transfers: In connection with a merger, acquisition, bankruptcy, or sale of assets, your information may be transferred to the acquiring entity
Strict SMS Privacy Protection. Text messaging opt-in data and consent records are kept strictly internal. We do not share, sell, or distribute your SMS opt-in information to any third parties or affiliates for their own marketing purposes. SMS opt-in data is shared only with our authorized infrastructure partners (such as Klaviyo) for the sole purpose of delivering SunBorn's own direct communications.
05 // SunBorn Purchase Assurance™ Data Sharing
If you opt into SunBorn Purchase Assurance™ at checkout, we share order-related information with our third-party protection partner, Seel, Inc., for the purpose of processing and administering your coverage. The information shared includes:
- Your name and email address
- Your shipping address
- Order details (items, quantities, value)
- Tracking and delivery information
Seel processes this information in accordance with their own Privacy Policy. By opting into Purchase Assurance™, you consent to this data sharing. If you do not purchase Purchase Assurance™ coverage, no data is shared with Seel for protection purposes.

06 // Email & SMS Marketing
If you provide your email address or mobile phone number through our sign-up forms or at checkout, you may receive marketing communications from us.
SMS / Text messaging: By consenting to SunBorn's SMS service, you agree to receive recurring automated promotional and personalized marketing text messages (e.g., drop alerts, cart reminders, exclusive offers) at the mobile number provided. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply from your carrier.
How to opt out:
- SMS: Reply STOP to any message at any time. Reply HELP for assistance.
- Email: Click the "Unsubscribe" link at the bottom of any marketing email.
It is your responsibility to provide an accurate and operational mobile number and email address.
07 // Shopify Infrastructure
Our Site is hosted by Shopify. Information you submit through the Site is transmitted to and shared with Shopify (and third parties located internationally) to provide the Services. Shopify may use information collected about your interactions with the Site to protect and improve its broader merchant network.
Shopify is responsible for responding to requests to exercise your rights over data processed for these purposes. You may review the Shopify Consumer Privacy Policy for more information. Depending on your region, you may exercise rights over your data via the Shopify Privacy Portal.
08 // Third-Party Links
The Site may contain links to external platforms, social media networks, and third-party websites. We are not responsible for the privacy practices or security of external sites. Information you share on third-party social platforms is governed by their respective privacy policies.
09 // Your Rights (CCPA, GDPR & Global Controls)
Depending on your jurisdiction (including the European Economic Area, United Kingdom, and California), you may have the following rights regarding your personal information:
- Right to access / know: Request information about the data we hold about you
- Right to deletion: Request that we erase your personal information from our systems
- Right to correction: Request modifications to inaccurate information
- Right to data portability: Request a copy of your information to transfer to another service
- Right to opt out of targeted advertising: Opt out of the "sale" or "sharing" of your data for targeted advertising purposes. If you use the Global Privacy Control (GPC) browser signal, we automatically treat this as a request to opt out.
- Right to withdraw consent (EEA/UK): Ask us to restrict processing or withdraw previously given consent
- Right to non-discrimination: We will not discriminate against you for exercising any of these rights
To exercise these rights: Email info@sunbornfc.com with a description of your request. We will respond within the timeframes required by applicable law.
Note on "Do Not Track": We do not currently recognize browser "Do Not Track" signals as a request to opt out of targeted advertising. We do, however, recognize the Global Privacy Control (GPC) signal.
10 // Children's Privacy
Our Services are not intended for use by children under the age of majority in their jurisdiction. We do not knowingly collect personal information from minors. If a parent or guardian believes a minor has provided us with personal information, they may contact us at info@sunbornfc.com to request its deletion.
11 // Data Security & Retention
We implement reasonable security measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction. However, no method of digital transmission or storage is 100% secure. We do not recommend using unsecured channels (e.g. public Wi-Fi without VPN) to communicate sensitive information.
We retain your personal information only as long as necessary to:
- Maintain your account and provide services
- Fulfill and support your orders
- Comply with legal obligations (tax records, fraud prevention)
- Resolve disputes and enforce our agreements
12 // Complaints & Disputes
If you have complaints regarding our handling of your personal information, please contact us first at info@sunbornfc.com so we can attempt to resolve the issue. If your complaint remains unresolved, you may lodge a complaint with your local data protection authority.
For EU/UK residents, you may contact your national data protection authority. For California residents, you may contact the California Attorney General's office.

We may update this Privacy Policy from time to time to reflect changes in our practices, services, or legal requirements. The updated version will be indicated by a revised "Last Updated" date at the top of this page. Material changes will be communicated through the Site or via email where appropriate. Your continued use of the Services after any update constitutes acceptance of the revised Privacy Policy.
